Shah moves Bombay High Court claiming Hungama had no right to release 'Lucky' on OTT earlier than its theatrical release

Actor-producer Soham Shah has filed a contempt of court case against Hungama Digital Media Entertainment Pvt Ltd for releasing his film Lucky on its streaming platform Hungama Play before the film's theatrical release.
Shah had earlier filed a suit in the Bombay High Court seeking to restrain Hungama from releasing the film on OTT before its theatrical release. The court had then directed Hungama not to release the film on OTT until further orders.
However, Hungama went ahead and released the film on its streaming platform on January 20, 2023, prompting Shah to file the contempt case.
In his contempt petition, Shah has alleged that Hungama has willfully and deliberately violated the court's order by releasing the film on OTT before its theatrical release.
Shah has also sought damages of Rs 1 crore from Hungama for the losses he has suffered due to the illegal release of the film on OTT.
The matter is now scheduled to be heard on February 15, 2023.
Background of the case
In 2021, Shah had entered into an agreement with Hungama for the distribution of his film Lucky. As per the agreement, the film was to be released in theaters first, followed by its release on Hungama Play.
However, in January 2023, Hungama informed Shah that it intended to release the film on its streaming platform before its theatrical release.
Shah objected to this and filed a suit in the Bombay High Court seeking to restrain Hungama from releasing the film on OTT before its theatrical release.
Court's order
On January 19, 2023, the Bombay High Court passed an order restraining Hungama from releasing the film on OTT until further orders.
The court also directed Hungama to file its reply to Shah's suit within two weeks.
Hungama's response
In its reply to Shah's suit, Hungama has denied the allegations made by Shah.
Hungama has contended that it had the right to release the film on OTT before its theatrical release, as per the agreement between the parties.
Hungama has also argued that the court's order restraining it from releasing the film on OTT was passed without giving it an opportunity to be heard.
